Appellate court upholds sentence in Spring Valley gun case

A Bolingbrook man convicted of possession of a weapon by a felon will keep serving his nine-year prison sentence. The Third District Appellate Court in Ottawa found that Spring Valley police weren’t wrong to stop 36-year old Quincy L. McCoy in August 2021.

Two officers had just heard gunshots and seconds later saw McCoy’s car leave the area the shots came from. No one else was driving at that early hour and the police found two guns in the car, including one in McCoy’s waistband. They also could see a gun box inside. McCoy claimed the stop, search, and seizure were unreasonable.

At his trial, McCoy claimed he heard the gunshots and fled without knowing his girlfriend’s guns were in the car. In his appeal, McCoy also claimed police and prosecutors should have turned over a video of him at the police station.

The appeals judges ruled that since the brief video had no sound and police didn’t talk to McCoy about the case anyway, it had no value to prosecutors or the defense. Even if the video had shown an extensive conversation, the justices say with no sound it would be speculation as to what anyone in it said.
