With the recent Presidential Executive Order allowing U.S. Immigration and Customs Enforcement (ICE) agents access to school campuses, I want to share the legal guidance L-P has received if ICE agents arrive on campus.
L-P firmly adheres to the Family Educational Rights and Privacy Act (FERPA), which protects the privacy of student records and data. If ICE agents enter our campus, they shall be required to provide legal documents supporting their requests. Each document will be reviewed by our District’s legal counsel prior to the District consenting to any request so that we minimize the chance of violating Illinois statutes and U.S. Supreme Court case law protecting the privacy and educational rights of students. Our intent is to fully comply with the agents and the law, however, with any request for student information, we do not simply hand that over without verifying the validity of the request. Staff have been informed that our building principal, Mrs. Cushing, and myself are the only authorized school officials to work with ICE agents coming to campus.
If new or additional guidelines emerge, we will work with our legal counsel to ensure we comply with both federal and state law.
