Timing can affect a lot in replacement of state’s attorney

When the process of naming the next LaSalle County State’s Attorney starts depends on when the current one turns in his resignation. County Board Chairman Don Jensen says as of Wednesday afternoon, he hadn’t received it from Todd Martin. Once he does, Jensen can figure out the deadline and whether that person’s appointed term lasts until later this year or until 2024.

If there are less than 28 months left in a four-year term when an office holder leaves, there won’t be a special election. That 28-month mark would be on August 1st. Martin will become a judge the next day. If his resignation takes effect on August 2nd, there won’t be a special election and Martin’s appointed replacement can stay in office through the end of November 2024. Otherwise, it’ll be up for election in November this year for a term starting December 1st.
