Malicious prosecution claims by one former LaSalle County state’s attorney against another have been dismissed from federal court. The judge is leaving certain matters up to the state court system.
Brian Towne sued Karen Donnelly, some other prosecutors, and some police officers after a judge dismissed an official misconduct case against him. But federal judge Sharon Johnson Coleman says he waited too long. Donnelly’s case against him started in 2017. Towne sued in 2020. The federal statute of limitations is two years.
The judge also found that the conditions of Towne’s bond didn’t amount to an infringement on his freedom. He didn’t have to pay cash to stay out of jail while the case was pending.
